R. v. Bird et al. 2 6. % Aid. 522. 5. The salary of the assistant overseer (if any have been appointed, ) under stat. 59 G. 3, c. 12, s. 7, shall be allowed to them. But an overseer cannot charge for a salary to himself: and therefore, where, upon appeal against an overseer's accounts, on the ground that a salary had been allowed to him, and was charged in the account, and the Sessions allowed it: the Court of King's Bench held, that no such charge could legally be made, saying, that an overseer has no right to a salary for his services; it being suggested, however, that this was really not a salary, but a sum paid
