Introduction. This chapter does not occur in Macaulay's Code. For special reasons, which have not been published, the Commissioners did not include in the Code any clause declaring to what places and to what classes of persons it should apply. Maeaulay.?We have not proposed to exempt from the operation of this Code any of the ancient sovereign houses of India residing within the Company's territories. Whether any such exception ought to be made is a question which, without a more accurate knowledge than we possess of existing treaties, of the sense in which these treaties have been understood, of the history of negotiations, of the temper and of the power of particular families, and of the feeling of the body of the people towards these families, we could not venture to decide. We only beg permission most respectfully to observe that every such exception is an evil; that it is an evil that any man should be above the law; that it is a still greater evil that the public should be taught to regard as a high and enviable distinction the privilege of being above the law; that the longer such privileges are supposed to last, the more difficult it is to take them away; and that we greatly doubt whether any consideration, All offences under this Act are to be enquired into and tried according to the provisions of the Code of Criminal Procedure, 1882?see Act X of 1882, ss. 5, 28.
