Certain acts which were supposed to amount to treason having been proved, evidence was offered for the purpose of connecting Colonel Burr with those who committed these acts, he having been at a great distance from the scene of action, in another Federal E(istrict and State; this evidence was objected to as irrelevant, and upon the question of its admission the Chief Justice gave the opinion of the court1 on August 31, 1807, as follows: Marshall, Chief Justice.
