Overview
This Contracts casebook explores doctrine using both traditional edited case opinions and abbreviated summaries of the facts and analysis in "Example" cases, so students can learn how courts articulate and apply the rules in a variety of common circumstances. Students learn actively by answering "reading critically" questions preceding cases and other primary source material and by responding to frequent problem sets. "Text boxes" are situated throughout the book to highlight crucial text, add historical context to the cases and doctrine, and offer opportunities to think beyond the details of the case. Tables and flowcharts demonstrate connections among concepts and give visual learning cues. With all of this guidance, students can learn the basic material more effectively, so they start class at a more sophisticated level and can proceed more easily to deeper analysis. The problem sets include essay and multiple-choice questions with respect to dispute resolution, client-advice, and transactional settings, which are helpful to students preparing for the NextGen bar exam.
The new (4th) edition introduces students to the recently promulgated Restatement of Consumer Contracts and to the 2022 UCC amendments, to the extent they affect basic contract law. In addition to classic contract cases, the book includes new cases chosen because of their teachability and because they address current issues and modern contracting practices, such as electronic contract formation, non-compete clauses, employee handbooks, pandemic transactions, and climate change. The book is suitable for 4-credit courses, as well as longer courses.
The book's electronic version links directly to cited sources and to related multiple-choice problems at the end of each chapter for student self-testing. The accompanying digital material includes more than 25 videos covering key concepts, for student use. Additional digital materials are available only to professors, for use in classroom or online discussions.
