To make either cruelty and barbarous treatment, or, indignities to the person of libellant a ground entitling a husband to obtain a divorce from his wife, the conduct complained of in the libel must also be therein alleged to be productive of a certain effect on the sensibilities of the complaining libellant viz: it must have rendered his condition intolerable or life burdensome, but it need not be alleged in the libel or proved In the evidence to have been also productive of another effect on libellant, viz: compelling of his abandonment of his house and family, to will h latter words the statute has ascribed no significance whatever when the husband is libellant. Where the occurrence disclosed by t he evidence in a case where a divorce is sought by the husband for indignities to his person are too trivial, too negative in character and too feebly s; pported by convincing evidence to warrant the conclusion that within th sense of the Act of Assembly in such a case, the libellant was offered such indignities to his person as to render his condition intolerable and life burdensome, a divorce will be refused.
