PKINCIPAL AND AGENT. Secret Agents.?Buying property through a secret agent is not a fact from which fraud may be inferred. If a secret agent buys in his own name, the seller is bound, and either the seller or the agent may sue on the contract. If the principal sues, the seller will occupy the same position as to defenses as that occupied by him at the time the principal was disclosed. Sub-agents.?The general principle is, delegatus non potest del- egare; but a power to delegate his authority, or to substitute another in his stead, may be conferred upon an agent either expressly, or by implication from the nature of the business in which the agent is employed. If the business is such that it obviously and reasonably requires the services of a sub-agent, or if there is a known and established usage of substitution in such business, the law implies such a power, and the principal will be bound by the acts of his agent's sub-agent. The maxim is for the protection of the principal. It does not shield an agent in chief from liability to his principal for the acts of a sub-agent appointed, without authority, by the agent in chief.
